¿Qué necesita SDE: modificación de la ley 176-07 o el cumplimento de la ley 166-03?

Revisando mi correo descubrí un articulo que escribí  para Visión Clave en el 2011 y  que por su vigencia decidí publicarlo  este domingo en planetard.net

El cumplimiento del artículo 21 de la ley 176-07   es imposible de consumar para la inmensa mayoría de los ayuntamientos, mientras el poder ejecutivo siga violando la ley 166-03 que establece  el régimen de cooperación y asistencia financiera del Poder Ejecutivo y los Ayuntamientos, que en su artículo 3 manda que a partir del 2005 le sea otorgado el 10% del presupuesto general del estado.

Aproximadamente 9 de cada 10 ayuntamientos necesitan sobrepasar el 25 %  de sus gastos en recursos humanos para poder cumplir mínimamente  con los servicios que ofrece  a su comunidad, porque su mayor fuente de ingreso es lo que el gobierno le otorga vía de  ley 166-03.

El legislador creo el artículo 21 de la ley 176-07 basado en que había una ley donde el estado contribuía con los ayuntamientos en la otorgación de un 10% del presupuesto general.

Sí el estado  de un 10% que debe entregar tan solo envía  a los municipios un 3%, entonces todos los gastos en inversión y otras actividades de desarrollo se disminuirán drásticamente. Por ejemplo, sí la inversión debía ser de un 50%, automáticamente se reduciría a un 15%.

Un ciudadano podría decir que debe reducirse todo para mantener la proporción del 50% en inversión, pero no es así, porque el personal que usa el ayuntamiento para los servicios cotidianos no puede reducirse, el gasto en la recogida de basura tampoco.

En definitiva, el cumplimiento de la distribución de los gastos de un ayuntamiento depende  de que el estado honre  el mandato presupuestario que indica  el artículo 3 de la  ley 166-03.

Santo Domingo Este es el municipio más grande del país, pero su generación de riqueza  y su nivel de desarrollo económico y social no están acorde con su enorme población.

La economía informal de Santo Domingo Este,  el crecimiento anárquico de su población y el desorden territorial  es un multiplicador de pobreza que dificulta la recaudación de ese ayuntamiento, por tal razón  produce arbitrio como un municipio pequeño y demanda servicio como la urbe más extensa del país.
