Caso Calamar: Peralta y Donald Guerrero a la reja por 18 meses; Gonzalo de risita con prisión en casa
La jueza Kenya Romero decidió hoy el futuro inmediato de los implicados en el caso de supuesta corrupción denominado Calamar por la Procuraduría General de la República.
La decisión de Romero fue mandar a prisión preventiva Donald Guerrero, pasado ministro de Hacienda y a José Ramón Peralta, ex ministro Administrativo de la Presidencia, por 18 meses.
En el caso de Gonzalo Castillo le impusieron arresto domiciliario, 20 millones de fianza, impedimento de salida del país y presentación periódica.
La jueza también declaró el caso como complejo, lo que le daría 18 meses de tiempo adicional para investigación al Ministerio Público.
Y también en el excontralor general de la República, Daniel Omar Caamaño, quien es defendido por el abogado Carlos Olivares, tendrá impedimento de salida del país y garantía económica de cuatro millones de pesos;y Aldo Antonio Gerbasi le fue impuesto lo mismo que a Caamaño.
Mientras que al exdirector del Consejo Estatal del Azúcar (CEA), Luis Miguel Piccirilo, le impusieron arresto domiciliario e impedimento de salida.
La magistrada es la coordinadora de los juzgados de atención permanente del Distrito Nacional, y la persona que ha conocido el caso desde que el Ministerio Público le pidió órdenes de arresto y de allanamiento al grupo.
La atención estaba centrada hoy en los exministros de Hacienda, Donald Guerrero Obras Públicas, Gonzalo Castillo, y administrativo de la Presidencia, José Ramón Peralta, para quienes los fiscales pidieron 18 meses de prisión preventiva.
Y también en el excontralor general de la República, Daniel Omar Caamaño; el exdirector del Consejo Estatal del Azúcar (CEA), Luis Miguel Piccirilo, y Aldo Antonio Gerbasi. Este fue el grupo de 6 personas que no pactaron con el Ministerio Público y que en cambio mantienen su declaración de inocencia de las imputaciones que se les han realizado.
El Ministerio Público había señalado al terminar los trabajos el lunes por la noche que existían las “condiciones” para que se impusieran los 18 meses de prisión preventiva como medida de coerción contra los seis implicados en el caso Calamar con los cuales no llegaron a un acuerdo.
En cambio, los que sí llegaron a algun tipo de acuerdo con las autoridades fueron el abogado Ángel Lockward, Roberto Santiago Moquete Ortiz, Alejandro Constanzo Sosa, Marcial Reyes, Ana Linda Fernández Paola, Emir José Fernández De Paola, Oscar Arturo Chalas Guerrero, Rafael Parmenio Rodríguez Bisonó, Agustín Mejía Ávila, Víctor Matías Encarnación Montero.
Además, Claudio Silver Peña, Yahaira Brito Encarnación y su esposo Ramón David Hernández.
Este caso comenzó con un operativo de 40 allanamientos la noche del sábado 18 de marzo y la madrugada del domingo 19. Desde entonces guarda prisión el grupo de encartados en la supuesta red de corrupción, que según los fiscales defraudaron al Estado dominicano con 19 mil millones de pesos.
Esta es la lista de medidas de coerción en el caso Calamar
1- Claudio Silver Peña, 226-1, 2 Y 6 (garantía económica, prohibición de salida del país y arresto domiciliario).
2. Ángel Gilbert Lockward Mella (Presentación periódica, prohibición de salida del país, prisión domiciliaria y garantía económica RD$7 millones efectivo)
3. Alejandro Antonio Constanzo Sosa 226 1, 2 Y 6 (RD$1 millón efectivo) (garantía económica, impedimento de salida y arresto domiciliario)
4. Roberto Santiago Moquete Ortiz (prohibicion de salida del país y arresto domiciliario).
5. Ramón David Hernández 226-1 (presentación periódica los días 30 de cada mes, prohibicion de salida del país, garantía económica (RD$1 millón) y arresto domiciliario).
6. Yahaira Brito Encarnación 226-2 (prohibicion de salida del país, garantia económica y arresto domiciliario).
7. Marcial Reyes 226-2 (Prohibicion de salida del país y arresto domiciliario).
8.Emir José Fernández de Paola (presentación periódica, impedimento de salida, arresto domiciliario y RD$2 millones es en modalidad contrato).
9. Oscar Arturo Chalas Guerrero 226-1 (presentacion periódica, prohibición de salida del país, detención en su domicilio y la garantía de RD$1 millón en efectivo)
10. Julian Omar Fernández Figueroa 226-2 y 6 (impedimento de salida y arresto domiciliario).
11. Rafael Parmento Rodríguez Bisonó 226-1 (presentacion periódica los días 30 de cada mes ante el MP Investigador (Pepca), prohibición de salida del país.
12. Agustín Mejía Ávila 226-1, 2 y 6 (garantía económica RD$500,000, impedimento de salida y arresto domiciliario).
13. Víctor Matías Encarnación Montero 226-1, 2 y 6 (garantía económica RD$3 millones, impedimento de salida y arresto domiciliario).
14.Ángel Donald Guerrero Ortiz (prisión preventiva cuyo plazo máximo es dieciocho meses a ser cumplidos en el Centro Correccional y de Rehabilitación Najayo CCR). Fija la revisión obligatoria de esta medida para el día 4 de julio de 2023.
15. José Ramón Francisco De Jesús Peralta Fernández (prisión preventiva cuyo plazo máximo es dieciocho (18) meses , a ser cumplidos en el Centro Correccional y de Rehabilitación Najayo CCR 20. Se fija la revisión obligatoria de esta medida para el día martes 4 del julio de 2023.
16. Gonzalo Castillo Terrero: arresto domiciliario e Impedimento de salida del país sin autorización judicial, garantía económica en modalidad contrato 20 millones en modalidad contrato fianza.
17. Daniel Omar de Jesús Caamaño Santana (impedimento de salida, garantía económica por valor de 4 millones en modalidad fianza).
18. Luis Miguel Piccirillo Mcabe: arresto domiciliario e impedimento de salida del pais sin autorización judicial.
19. Aldo Antonio Gerbasi Fernández garantia económica de 5 millones en modalidad contrato e impedimento de salida del país sin autorización judicial.
20. Ana Linda Fernández Paola: arresto domiciliario con autorización para asistir a todos los procedimientos médicos informados por sus abogados al tribunal.
