A José Laluz no le da ni frio ni calor expulsión del PLD

El Tribunal Nacional de Disciplina y Ética del Partido de la Liberación Dominicana (PLD) dispuso la desafiliación de esa organización del comunicador José Laluz Núñez, “en virtud de su renuncia tácita y notoria”.

Mediante resolución, el órgano disciplinario peledeísta ordena a la Secretaría de Organización separarlo de los registros partidarios, incluyendo su membresía en el Comité Central.

Tribunal Nacional de Disciplina y Ética está presidido por Alejandrina Germán, e integrado, además, de John Garrido, Manuel Galván, Luis García, Elic Fernández, Teodoro Ursino Reyes y Gustavo Guzmán

Refiere que el órgano ha tenido acceso a diversos videos y audios en los cuales Laluz Núñez se expresa en el sentido de que ya no pertenece al PLD, “pronunciamientos marcadamente ácidos y hasta, en cierto punto, irrespetuosos respecto del Partido de la Liberación Dominicana y a su dirigencia”.

La afiliación a un partido político es la manifestación libre y voluntaria de un ciudadano de pertenecer a una organización política, agrega, y con esto participar democráticamente en la vida política del país.

Precisa que, del mismo modo, todo afiliado a un partido, agrupación o movimiento político, goza de la prerrogativa de renunciar en cualquier momento, sin expresión de causa, en atención a lo dispuesto por el párrafo I del artículo 7 de la Ley No. 33-18, sobre Partidos, Agrupaciones y Movimientos Políticos.

Refiere que para que opere la renuncia de un afiliado no es condición sine qua non que la misma se haya presentado por escrito a la autoridad competente, “especialmente cuando tal renuncia se constituye en un hecho notorio, como ocurre en el caso del señor José Laluz Núñez, quien no solo se ha referido públicamente a su renuncia tácita al Partido de la Liberación Dominicana, sino que lo hizo hasta musicalmente dedicando un rap refiriendo pronunciamientos en contra la organización y expresando su salida”.

Respecto a un hecho notorio, la resolución del Tribunal Nacional de Disciplina y Etica del PLD hace énfasis en varias jurisprudencias, entre ellas la sentencia del Tribunal Constitucional C-086/16, del 24 de febrero de 2016, cuando señala que “se trata de cualquier acontecimiento conocido por todos los miembros del engranaje social, respecto del cual no hay duda ni discusión; en tal sentido, se exime de prueba, por cuanto forma parte del dominio público”.

La resolución señala que las actuaciones del exdiputado constituyen un mal ejemplo para los actuales y futuros afiliados en el PLD.

El referido Tribunal notificó a José Laluz Nuñez la decisión mediante acto formal de alguacil, así como a las instancias partidarias. Según  un colaborador que pidió reserva de su nombre, José Laluz ni se inmuto cuando le mostraron la notificación.
