Condenan a cinco años de prisión a la diputada del PRM Rosa Amalia Pilarte
A unanimidad, la Segunda Sala Penal de la Suprema Corte de Justicia encontró culpable a la diputada del Partido Revolucionario Moderno(PRM), Rosa Amalia Pilarte, de lavado de activos y financiamiento del terrorismo.
El tribunal que la condenaó está presidido por Francisco Jerez Mena e integrado por María Garabito, Nancy Salcedo Fernández, Fran Soto y Francisco Ortega Polanco.
La condena a cinco años de reclusión deberá ser cumplida centro de Corrección y Rehabilitación Rafey Mujeres, en Santiago, además del pago de una multa de 200 salarios mínimos del sector público.
Asimismo, se ordenó el decomiso a favor del Estado dominicano de varios inmuebles ubicados en La Vega, entre ellos un terrero un inmueble de 728.11 metro cuadrados, otro inmueble de 811.45 metros cuadrados, otro inmueble de 682.50 metros cuadrados; un inmueble 1492.42 metros cuadrados; parcela #11 con una extensión de 28,273 metros cuadrados; el local comercial con una extensión 35.75 metros cuadrados; inmueble identificado como comunidad funcional B1, de una extensión 46.86 metros cuadrados.
Un inmueble de extensión 1,728 metros cuadrados, una porción de terrenos de 15,251.20 metros cuadrados; porción de terreno con una extensión de 11,314 metros cuadrados, el inmueble dentro de un solar de una extensión19.04 metros cuadrados; inmueble en Jarabacoa de 628,863.50 metros cuadrados.
El Ministerio Público había pedido una condena de 10 años de prisión.
La acusación
Según el expediente acusatorio depositado contra la legisladora, Pilarte formaba parte de una estructura criminal dedicada al lavado de activos que dirigía su esposo y también acusado por el Ministerio Público Miguel Arturo López Florencio (Miky López).
El modus operandi de la red era colocar sumas cuantiosas de dinero en el sistema financiero y otras ramas de la actividad económica para lograr “diversificar el producto proveniente del narcotráfico, aprovechando y utilizando vínculos familiares y de afinidad para hacer más eficaz dicha actividad ilícita de lavado de activos”.
Los fiscales a cargo de la acusación señalaron la existencia de transacciones bancarias realizadas por Pilarte que reflejan montos millonarios producto de las actividades ilícitas del entramado, estableciendo como la mujer era partícipe de la red de lavado junto a su esposo y también acusado Miguel Arturo López Florencio (Miky López).
“Las millonarias sumas no guardan relación con sus actividades productivas e ingresos lícitos conocidos y declarados a las autoridades”, señalaba la acusación.
